Far-left publications everywhere are calling for lawmakers to take former President Trump off the 2024 ballot in states across the country using the 14th Amendment of the Constitution.

The Atlantic, The Guardian, The L.A. Times, UPI, and others have all recently demanded state lawmakers use Section 3 of the 14th Amendment to disqualify Trump from running for president in 2024, citing the January 6 “insurrection.”

According to the provision, no person who has taken an oath “as an officer of the United States” can hold office if they “have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

That language disqualifies Trump from running for office because of his efforts to overturn the 2020 election, two prominent conservative scholars, William Baude of the University of Chicago and Michael Stokes Paulsen of the University of St Thomas, concluded in a much–discussed article to be published the University of Pennsylvania Law Review.

“The bottom line is that Donald Trump ‘engaged in insurrection or rebellion’ and gave ‘aid or comfort’ to others engaging in such conduct, within the original meaning of those terms as employed in section 3 of the 14th amendment,” Baude and Paulsen wrote in their 126-page article, which traces the history and original understanding of the amendment. “If the public record is accurate, the case is not even close.”

Legal groups are signaling that various state challenges against Trump’s eligibility are forthcoming and will be everywhere soon.

“The American public should expect to see a series of challenges filed in state after state,” says Ron Fein, legal director of one such group, Free Speech for People.

Challenges likely will come toward the end of this year and early next year, as the deadlines hit for candidates to file for the ballot, and could dominate the early months of the primary season.

“People are not anticipating how pervasive these will be,” said Notre Dame law professor Derek Muller, an election law expert.

The question is, why are the Democrats suddenly so interested in taking Trump off the ballot now, over two and a half years after the January 6 Capitol protest?

The answer likely has something to do with the fact that Trump’s popularity has only skyrocketed since receiving four criminal indictments over the last several months ranging from his retention of classified documents to his effort to get to the bottom of election fraud in Georgia.

Of course, Trump didn’t participate in an “insurrection,” because the protest that devolved into an FBI-staged riot was not an armed insurrection to begin with.

Additionally, Trump did not encourage or incite violence in any way. Rather, he cautioned supporters to “peacefully and patriotically” protest at the Capitol.

It’s unsurprising to see the far-left media and academia attempt to weaponize the very Constitution they despise to take down their political opposition, especially given the Democrats’ lawfare currently being waged against Trump.

The signal has been sent: prepare for many state challenges to prevent Trump from being on the presidential ballot in 2024.
